This includes your use of our official website, https://ideavideo.ai/ (the “Website”), as well as the IdeaVideo AI mobile application available on the Apple App Store and Google Play Store (the “Application”). This Privacy Policy also explains your privacy rights and how the law protects your Personal Data.

We use your Personal Data to provide and improve the Services. By using the Website or the Application, you agree to the collection and use of Personal Data in accordance with this Privacy Policy.

Words defined in this Policy have the same meaning whether they appear in the singular or plural.

1.2. Definitions

For purposes of this Privacy Policy:

• Website means ideavideo.ai, accessible at https://ideavideo.ai/.
• Application means the IdeaVideo AI mobile application available for download from the Apple App Store and Google Play Store.
• Account means a unique account created for you to access our Services or parts of our Services.
• Company (referred to in this Policy as the “Company,” “we,” “us,” or “our”) means IdeaVideo AI.
• Cookie means a file placed on your computer, mobile device, or other device by a website that contains details of your browsing history on that website and information used for various purposes.
• Device means any device that can access the Services, such as a computer, mobile phone, digital tablet, or other device capable of installing the Application.
• Personal Data means any information relating to an identified or identifiable individual.
• Services means the products, features, or tools we provide that are powered by artificial intelligence, machine learning, or similar technologies (collectively, “AI Products”). These tools are designed to provide functionality such as image and video generation, AI automation, and image analysis, offering innovative solutions to you. The terms of this Privacy Policy govern your use of AI Products through our Services, including through the Website or Application.
• Third-Party Social Media Service means any website or social network through which a user may log in or create an Account to use the Services.
• You means the individual accessing or using the Services, or the company or other legal entity on behalf of which such individual is accessing or using the Services, as applicable.

2. Collection and Use of Your Personal Data

2.1. Types of Data We May Collect

2.1.1. Personal Data

While using our Services, whether through the Website or Application, we may collect Personal Data that you voluntarily provide as well as Personal Data generated through your use of the Services, including but not limited to:

• Email address
• Usage Data
• Social media information
• Cookies and related online data

If you install or use the Application, we may also collect additional technical data, such as application usage statistics, crash logs, and unique device identifiers, to help us monitor and improve the functionality and performance of the Application.

2.1.2. Information from Third-Party Social Media Services

The Company allows you to create an Account and log in to use the Services through the following Third-Party Social Media Services:

• Google
• Facebook
• Twitter

If you choose to register through a Third-Party Social Media Service or authorize us to access it, we may collect Personal Data already associated with that third-party account, such as your name, email address, activities, or contact list. This applies whether you interact with these services through the Website or Application.

2.1.3. Tracking Technologies and Cookies

We use Cookies and similar tracking technologies to track activity on our Services and store certain information. Tracking technologies used include beacons, tags, and scripts to collect and track information and to improve and analyze our Services.

• Cookies or Browser Cookies. A Cookie is a small file placed on your Device. You can instruct your browser to refuse all Cookies or to indicate when a Cookie is being sent. However, if you do not accept Cookies, you may not be able to use certain parts of our Services.
• When you use the Application, we may use mobile analytics software and other tracking technologies to collect information related to application performance so that we can understand how you interact with the Application and make improvements.

2.1.4. Application Permissions and Device Features

Depending on the features you choose to use in the Application, we may request access to certain features or data on your Device, such as:

• Camera and Photos: Used to create images or videos or perform image analysis.
• Push Notifications: Used to notify you about updates, features, or Service-related messages.
• Microphone: Used if voice or audio input is part of a Service feature.

You can manage or revoke these permissions at any time through your Device settings. Please note, however, that disabling certain permissions may limit or prevent some Service features in the Application from functioning properly.

2.1.5. Facial Data, Photos, and iOS Biometric Use

On iOS, our Application does not collect or process facial recognition data or biometric data for artificial intelligence or analytics purposes.

If you choose to use Sign in with Apple to log in, the system may use Face ID or another biometric authentication method to verify your identity. However, this authentication is handled entirely by Apple, and IdeaVideo AI does not access or store any biometric data.

When using features such as the camera or photo uploads, images may contain faces. For non-public images, such images are used only to complete the AI image or video generation you request and other image-processing operations, such as stylization or transformation.

For non-public uploaded images, we use them only to the extent necessary to complete the creation, processing, and delivery of results that you request. Uploaded images are temporarily stored on our servers for processing and are automatically deleted shortly after content generation or processing is completed. In certain cases, images may be shared with trusted third-party rendering providers that are contractually prohibited from retaining or misusing the relevant data.

“Public Content” includes only generated content that you actively choose to make public, together with any uploaded images or other materials that you explicitly choose to make public with it. Making generated content public does not automatically make the uploaded images or other materials on which it is based public. The use, display, distribution, promotion, and licensing of Public Content in connection with AI model improvement are governed by Section 5.4 of our Terms of Service. Except in the foregoing public circumstances or where you separately provide explicit authorization, we will not use non-public uploaded images for promotional purposes or AI model training.

2.2. Use of Personal Data

The Company may use Personal Data for the following purposes:

• To provide and maintain our Services, including monitoring the use of the Services on our Website and Application.
• To manage your Account: to manage your registration as a user of the Services. The Personal Data you provide may give you access to different features of the Services that are available to you as a registered user.
• To provide you with news, special offers, and general information about other goods, services, and events that we offer and that are similar to those you have already purchased or inquired about, unless you have opted not to receive such information.
• To manage your requests: to process and manage requests you submit to us.
• For other purposes: we may use your Personal Data for other purposes, such as data analysis, identifying usage trends, evaluating the effectiveness of promotional campaigns, and evaluating and improving our Services, products, marketing, and your overall experience.
• In the Application environment, this may specifically include sending push notifications, processing in-app transactions, providing personalized recommendations, and resolving Application-related performance issues.

2.3. Retention of Personal Data

The Company will retain your Personal Data only for as long as necessary for the purposes set out in this Privacy Policy. We will retain and use your Personal Data to the extent necessary to comply with legal obligations (for example, where applicable law requires us to retain your Personal Data), resolve disputes, and enforce our legal agreements and policies.

The Company will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period, unless such data is used to strengthen security or improve the functionality of our Services, or we are legally obligated to retain it for a longer period. This applies to data collected from both the Website and Application.

2.4. Deletion of Your Personal Data

You have the right to delete or request that we assist in deleting Personal Data that we have collected about you.

Our Services may allow you to delete certain Personal Data about you from within the Services. For example, this may include options to delete certain data through Application settings, where available.

You may update, modify, or delete your Personal Data at any time by logging into your Account, if you have one, and visiting the Account settings section that allows you to manage your Personal Data. You may also contact us to request access to, correction of, or deletion of any Personal Data that you have provided to us. If you wish to stop data collection through the Application, you may uninstall the Application at any time.

2.5. Security of Your Personal Data

The security of your Personal Data is important to us, but please remember that no method of transmission over the Internet or method of electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your Personal Data, we cannot guarantee its absolute security.

You are responsible for keeping your Device and the credentials used to access the Application secure. We recommend enabling all available security features, such as a password or fingerprint lock, to protect access to the Application and any Personal Data stored or processed within it.

3. Third-Party Artificial Intelligence Processors

To provide advanced AI-powered video and image generation Services, we work with multiple third-party AI model providers.

• List of processors: Depending on the specific model or feature you select within the Services, your Personal Data may be processed by providers including, but not limited to, OpenAI (Sora), Kuaishou (Kling), Google, Runway, MiniMax (Hailuo), and Alibaba (Wan).
• Content we share: We share only the minimum information necessary for content generation, specifically including user-provided text prompts, uploaded images or videos, and style preferences.
• Data minimization and anonymization: We do not share personally identifiable sensitive Personal Data, such as your Account ID, email address, real name, or precise geolocation data, with these third-party AI processors. Where technically feasible, all data used for AI processing will be de-identified to protect your privacy.

3.1. User Control and Choice

We strongly believe that you should have full control over how your Personal Data is processed.

• Model selection: The Services provide a “model” or “engine” switching feature. By selecting a particular AI model, for example by switching from Kling to Runway, you are exercising your right to determine which third-party service provider processes your creative input.
• Opt-out: If you do not want your Personal Data to be processed by a particular third-party provider, you may choose another model or refrain from using features provided by that particular provider.

4. Content Restrictions

To maintain a safe, ethical, and responsible platform, we establish the following content restrictions for all users of this AI content generation platform. These restrictions apply to all content generated, uploaded, or shared on the platform.

Because AI-generated results may be unpredictable, the Services are intended only for users who are 18 years of age or older.

Your Content must not contain nudity, biometric data, violence, pornography, or any harmful, hateful, harassing, or otherwise offensive content, with the Company retaining final authority to interpret these restrictions. You may not upload, generate, or provide any image, likeness, voice, or other content of another person without that person’s permission or sufficient authorization. The rights granted to you under our Terms of Service are conditioned on your compliance with these restrictions. Any unauthorized use of the Services will automatically terminate the license granted to you under the Terms of Service.

4.1. Prohibited Content

We prohibit the following types of content:

• Illegal Content: Any content that promotes, facilitates, or involves illegal activities, including but not limited to fraud, violence, or the sale of illegal goods and services.
• Harmful Content: Content that incites hatred or violence, discriminatory content based on race, religion, gender, sexual orientation, or other legally protected characteristics, as well as terrorism-related material or sensitive political content.
• Explicit or Adult Content: Pornography, excessive violence, or other inappropriate content, including depictions of sexual abuse, child exploitation, or animal abuse.
• Intellectual Property Infringement: Content that infringes another party’s copyright, trademark, or other intellectual property rights.
• False or Misleading Content: Content that is intentionally false, misleading, or deceptive, particularly when presented as fact.
• Privacy Violations: Content that discloses Personal Data without consent or otherwise violates another person’s privacy.
• Hate Speech: Content that promotes hatred, discrimination, or hostility toward an individual or group based on protected characteristics.
• Harassment and Bullying: Content intended to harass, threaten, or bully an individual or group.
• Self-Harm and Suicide: Content that promotes or glorifies self-harm, suicide, or other dangerous behavior.

• You may not use another person’s likeness, voice, or biometric data without authorization.
• Content must not include deepfakes or impersonation intended to mislead, defraud, or manipulate.
• Sensitive Personal Data must not be used as input unless permitted by law and authorized by the user.
• AI-generated content must not be misleadingly presented as factual, human-created, or endorsed by any real person or organization.
• Creating content involving the sexual exploitation, abuse, or endangerment of minors is prohibited.

4.3. Enforcement

We actively monitor and enforce these content restrictions to maintain a safe and responsible platform environment. We reserve the right to:

• Remove or restrict any content that violates these guidelines without prior notice.
• Suspend or permanently terminate accounts that violate these guidelines, at our discretion.
• Take legal action where necessary to protect our platform, users, and third parties from harm.

We take these responsibilities seriously and are committed to enforcing these requirements promptly and consistently. By continuing to use our Services, you accept these restrictions and our right to enforce them.

5. Your Choices and Opt-Out Rights

IdeaVideo AI collects and uses Personal Data to provide and improve our Services, personalize your experience, and deliver relevant advertising. We respect your privacy, and the following describes how you can manage or restrict certain uses of your Personal Data:

1. Browser Settings: You can configure your browser settings to refuse Cookies. Please note that doing so may affect the full functionality of our Website and the Services we provide.

3. Deactivate Account: You may contact us at any time to request deactivation of your Account. Please send your request to support@ideavideo.ai. Once your Account is deactivated, we will stop providing Services through that Account, but deactivation of an Account does not constitute deletion of Personal Data. To access, correct, or delete your Personal Data, please contact us as described in Section 2.4 of this Policy.
